This criminal appeal filed by the appellant-accused under Section 374(2) of Cr.P.C. is directed against the impugned judgment of conviction and order of sentence dated 24.09.2007, passed by the learned Special Judge (NDPS Act), Durg (C.G.) in NDPS Special Case No. 07/2006, whereby the appellant-accused has been convicted for offence under Section 20(b)(ii)(B) of N.D.P.S. Act and Digitally signed by HEERA LAL SAHU Date: 2025.02.21 10:20:43 +0530 2 sentenced to undergo R.I. for 3 years with fine of Rs.3000/- with default stipulation. 2. In this case, vide order of this Court dated 15.01.2025 bailable warrant was issued against the appellant returned unserved with a report of Office of Station House Officer, Police Station – Dadhi, District – Bemetara, C.G. stating therein that the appellant died on 28.11.2020. A death certificate of the appellant has been attached with the report, to this effect. 3. Learned State counsel agrees with the report that the sole appellant of the case has died. 4. In view of the matter, this Criminal Appeal stands disposed of as the legal representative of the appellant has not approached to contest the appeal.
