Heard learned counsel for the parties and perused the record. 2. This petition has been filed for the following relief: "(I) To issue a writ, order or direction in the nature of mandamus interdicting the respondents from making encroachment over any portion of plot no.45 village Jafarpur @ Odhapur (Kotana), District Baghpat and constructing RCC dumping ground over the same." 3. Learned counsel for the Gaon Sabha has submitted instruction and according to which no construction is being raised over the Khasra No.44 belonging to the petitioner and the constructions are being raised over arazi no.45 which belongs to the Gaon Sabha. 4. In view of the stand taken by the respondents in the instruction, no further orders are required to be passed. 5. Accordingly, the writ petition stands disposed of with a direction that the land of the petitioner shall not be used for construction except in accordance with law.
