BEFORE HONOURABLE MR. JUSTICE MICHAEL ZOTHANKHUMA ORDER Date : 16.06.2025 Heard Mr. N. Borah, learned counsel for the petitioner, Ms. U. Das, learned counsel for the respondent Nos. 1, 2 & 5 and Mr. D. Mahanta, learned counsel for the respondent Nos. 6 & 7. 2. The petitioner’s case is that pursuant to a Notice dated NIL for settlement of Mahabhairav Market in Tezpur Town, the petitioner along with the others submitted their bids. All the bidders had submitted the same bid amount of Rs.14,55,300/-. However, without giving any specific reason, the bid of the respondent No. 6 was accepted by the respondent authorities and the market was settled with the respondent No.6. Page No.# 3/3
3. The petitioner’s counsel submits that the petitioner submitted a representation dated 31.03.2025 to the Chairman, Tezpur Municipal Board, asking as to why the market had been settled with the respondent No.6, though the petitioner had more experience than the respondent No.6 in running a market.
He submits that the petitioner’s representation has not been decided till date and as such, this writ petition may be disposed of, with a direction to the respondent No.4 to take a decision on the petitioner’s representation, within a specified time period. 4. The counsels for the respondents submit that they do not have any objection to the prayer made by the petitioner’s counsel. 5. In view of the consent of the parties, this writ petition is disposed of, with a direction to the respondent No.4, to take a decision on the petitioner’s representation dated 31.03.2025, after giving an opportunity of hearing to the respondent No.6. The entire exercise should be concluded within a period of 3 (three) weeks, from the date of receipt of a certified copy of this order and a copy of the writ petition. 6.
