Hon'ble Prakash Padia,J. 1. The petitioner is a Gram Pradhan. The present writ petition has been filed to quash the proceedings dated 06.07.2024 for allotment of Fair Price Shop passed by the Tehsil Level Dukan Aavantan/ Selection Samiti, Tehsil Sadar, District Mirzapur as well as order dated 26.09.2024 passed by the Sub Division Officer, Sadar, District- Mirzapur. 2. It is argued that the proceedings for allotment of Fair Price Shop was initiated without any resolution of the Gram Panchayat, Gaura which is in violation of the Government Order dated 05.08.2019 and 07.07.2020. 3. Aggrieved against the aforesaid, the petitioner also made a complaint before the authorities since no decision has been taken, hence the present writ petition. 4. On the other hand, it is argued by the learned Standing Counsel appearing on behalf of State-Respondents that the necessary decision will be taken by the concerned competent authority, expeditiously. 5. Heard counsel for the parties. 6. With the consent of the counsel for the parties, the present writ petition is disposed of finally permitting the petitioners to submit a fresh representation ventilating all their grievances before the Respondent No.4 namely Sub Divisional Magistrate (Chairman) Tehsil Sadar, District Mirzapur. If such representation is filed by the petitioners within a period of four weeks from today, the Respondent No. 4 will take decision on the same expeditiously and preferably within a period of two months thereafter. 7. Needless to say that the decision is taken strictly in accordance with law after providing opportunity of hearing to all the parties concerned, unless there is no legal impediment.
