Heard learned counsel for the parties. 2. Present petition has been preferred with the following prayer:- "I. Issue order, or direction to the Additional Chief Judicial Magistrate III, Gautam Budh Nagar for deciding the complaint case no. 11 of 2023 (Anit Bhati Vs Rajesh Kumar) Under Section 138 of N.I. Act, 1881, Police Station- Beta-II, District-Gautam Budh Nagar, pending in the Court of Additional Chief Judicial Magistrate, District-Gautam Budh Nagar within reasonable stipulated time period preferably within a period of 6 Months." 3. In pursuance to the summons, respondent has already put his appearance by way of extending bail in his favour, and matter is pending for the last near about 2 years, but nothing fruitful proceeding has been initiated thereafter only by way of granting dates on each and every occasion on one pretext to another, nothing substantial has come up from pendency of the matter. 4. Considering the innocuous prayer as made by learned counsel for the petitioner, learned Court of Additional Chief Judicial Magistrate III, Gautam Budh Nagar/concerned court is hereby directed to expedite the aforesaid matter as expeditiously as possible, preferably within next 12 months from the date of production of certified copy of this order by way of giving proper opportunity of hearing to all the concerns in accordance with law. 5. Both the parties are hereby directed to extend their full co- operation to learned concerned court for receiving directions as made above and at the same time, it is also requested to learned concerned court for not extending unnecessary adjournment to any of the parties. 6. The instant petition stands disposed of accordingly.
