The instant application under Section 482 Cr.P.C. has been filed seeking direction for expeditious disposal of Case No. 594 of 2020 (Rijwana vs. Zakir Husain), u/S 125 Cr.P.C., P.S.- Phulpur, District- Varanasi, pending in the court of learned Additional Principal Judge, Family Court, Court No.3, Varanasi. 3. Learned counsel of the applicant submits that application under section 125 Cr.P.C., filed by the applicants, has been pending since 03.10.2020. Initially, the proceedings were proceeded ex parte against the opposite party no.2, however, the said ex parte order was set-aside on 22.09.2021, on an application moved by the opposite party no.2. Thereafter, again the opposite party no.2 is delaying the proceedings deliberately. Therefore, learned counsel for the applicant seeks a direction for expeditious disposal of the instant application filed by the applicant herein. 4. Having heard the submissions so made by learned counsel for the parties and looking at the facts and circumstances of the instant case, the instant application is disposed of with a direction to the trial court concerned to proceed in the matter expeditiously without granting any unnecessary adjournment to either of the parties.
