1. By way of this writ petition, the petitioner has prayed for following reliefs:
“10.1. That, the Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case of petitioner. 10.2 That, this Hon’ble court may kindly be SHUBHAM DEY Digitally signed by SHUBHAM DEY
2 pleased to direct the respondent authorities to grant compassionate appointment to the petitioner in light of the notification/order dated 13.11.2020 (Annexure P/3). 10.3 That, this Hon’ble Court may kindly be pleased to grant any other relief, as it may deem fit.
10.4. The cost of the petition may kindly be granted in favour of the petitoners.”

Learned counsel for the petitioner submits that the husband of the petitioner died-in-harness at the age of 52 years on 23.11.2023, while working on the post of Inspector (Police), Home Department, Chhattisgarh as he was suffering from brain related ailments caused due to COVID-19. Due to the demise of the husband of the petitioner, she filed an application dated 15.02.2024 (Annexure P/2) for grant of compassionate appointment before the Respondent No. 4 enclosing all the relevant documents and requisite qualifications.
3. He submits that even though the petitioner is having higher qualifications, she has been discriminated. In similar circumstances, the respondent authorities have granted appointment to the other similarly situated persons as per the notification dated 13.11.2020 (Annexure P/3). He also submits that the petitioner have also preferred a representation before the Respondent No. 2 dated 15.04.2024 (Annexure P/5) for considering the case of the petitioner, but till date, no decision has been taken by the respondents. Thus, a direction may be issued to the respondents to consider and decide the
3 representation/application submitted by the petitioner at the earliest.

On the other hand, learned counsel appearing for the Respondents/State opposes the said submissions made by the counsel for the petitioner and would submit that as the petitioner is not pressing this writ petition on merits and is only seeking direction to the respondents to take decision on the application for grant of compassionate appointment, he is having no objection. He however submits that the representation has been submitted by the petitioner on 15.04.2024 (Annexure P/5), if it is still pending
consideration, it will be considered in accordance with law.
5. I have heard learned counsel for the respective parties and perused the documents placed on record.
6. Petitioner has enclosed the copy of the death certificate of her husband namely, Sandeep Chandrakar (Annexure P/1). Thereafter, the petitioner submitted an application for grant of compassionate appointment dated 15.01.2024 which is enclosed as Annexure P/2. Thereafter, the petitioner submitted a representation dated 15.04.2024 (Annexure P/5) to the Respondent No. 2 for grant of compassionate appointment for the post of A.S.I. (M). As stated by the counsel for petitioner, the said application is still pending consideration. In the aforementioned
facts of the case, instead of keeping this writ petition pending, seeking reply from the respondents, it will be in the interest of the parties to dispose of this writ petition with a direction to the
4 Respondent No. 2 to take decision on the application for grant of compassionate appointment dated 15.04.2024 (Annexure P/5) submitted by the petitioner in accordance with law expeditiously, preferably within a period of 02 months form the date of receipt of the order. It is ordered accordingly.
7. Accordingly, this petition stands disposed of with aforesaid observations and directions.
