This application has been filed to expedite the trial of Criminal Case No.7419 of 2022 (State vs. Vijay Shankar Tripathi and others) arising out of Case Crime No.1 of 2020 under Sections 498-A, 323, 504 IPC and Section 3/4 Dowry Prohibition Act, 1961, Police Station-Mahila Thana, District-Rae Bareli, pending before the court below. 2. However, learned AGA raised a preliminary objection that the present application is not maintainable under Section 482 Cr.P.C. as the same has been filed after the enforcement of new criminal Law. 3. At this stage, learned counsel for the applicant seeks permission to withdraw this case with liberty to file an application under Section 529 B.N.S.S. for expediting the trial in question. 4. With the aforesaid direction, present application is dismissed as withdrawn with the aforesaid liberty. 5. Certified copy of the impugned order be returned to counsel for the applicant after retaining a photocopy of the same.
