[2025:RJ-JP:11714] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 3802/2025 1. Madanlal S/o Shravanlal, Aged About 29 Years, R/o Basdi Khurd, Police Station Kishangarh Renwal, District Jaipur. 2. Sagarmal S/o Dhannalal, Aged About 40 Years, R/o Basdi Khurd, Police Station Kishangarh Renwal, District Jaipur. ----Petitioners Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Harendra Singh For Respondent(s) : Mr. Amit Kumar Gupta, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 12/03/2025 1. The instant bail application has been filed under Section 482 of BNSS in connection with FIR No. 315/2019 registered at Police Station Renwal, District Jaipur Rural for the offences punishable under Sections 307, 436 and 447 of IPC. 2. It is contended by learned counsel for the petitioners that the accused-petitioners have falsely been implicated in this case. It is submitted that during the course of investigation, petitioners were not found involved in commission of the offence and charge-sheet was filed only against accused namely- Shravan Lal. It is submitted that matter was committed to the Court of Sessions as offences under sections 307 and 436 of IPC are exclusively trial by the court of sessions. It is submitted that after hearing the arguments on charge, petitioners have been summoned through bailable warrants in exercise of powers under section 319 Cr.PC as an additional accused. Counsel submits that there is reasonable apprehension in the mind of the petitioners that they might be sent to judicial [2025:RJ-JP:11714] (2 of 2) [CRLMB-3802/2025] custody on appearance. It is further submitted that petitioners are ready to face trial and judicial custody of the petitioners would not serve any fruitful purpose. Counsel thus, prays that petitioners may be granted benefit of anticipatory bail in this matter. 3. Learned Public Prosecutor opposes the submissions made by the counsel for the petitioner. 4. Considering the contentions put-forth by learned counsel for the petitioners and taking into account the totality of facts and circumstances of the case, especially the fact that during the course of investigation, petitioners were not found involved in commission of the offence thereafter, they have been summoned through bailable warrants in exercise of powers under section 319 Cr.PC as an additional accused, but without expressing any opinion on the merits/demerits of the case, this court deems it just and proper to dispose of this anticipatory bail application with direction to the petitioners that they shall appear before the concerned Court on or before 25.03.2025 and submit their bail bonds to the satisfaction of the said court. Concerned Court is directed to accept the bail bonds of the petitioners. 5. With the aforesaid directions, the instant criminal misc. bail application is disposed of. 6. It is made clear that this order will lose its currency in case the petitioners fail to appear before the learned trial Court on or before the given time. (ANIL KUMAR UPMAN),J pcg/1060
