Order No.02 Dated- 17.04.2025
Heard the parties.
The petitioner has moved this Court for grant of privilege of bail in connection with Barharwa P.S. Case No.190 of 2024 registered for the offences punishable under sections 103/3(5) of the B.N.S., 2023.
The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused persons has committed the murder of Utpal Mandal. It is further submitted that the allegations against the petitioner are all false and the co-accused- mother of the petitioner namely Kaushalya Devi in her confessional statement has categorically stated that she herself has only committed the murder of Utpal Mandal and the same has been mentioned in paragraph no. 33 of the case dairy and the only allegation against the petitioner is that the petitioner was accompanying Kaushalya Devi to the place of occurrence. It is then submitted that police also seized blouse, petticoat and sari of Kaushalya Devi during the investigation of the case as is evident from the search and seizure memo, copy of which has been kept at page no. 15 of the brief. It is then submitted that the petitioner has been in custody since 30.11.2024 as has been mentioned in paragraph no. 01 of the bail application. It is next submitted that the petitioner undertakes to cooperate with the trial of the case and
further undertakes that he will not annoy or disturb the informant or any of his family members in any manner during the trial of the case. It is lastly submitted that the co-accused person has already been admitted to bail by a coordinate Bench of this Court vide
order dated 03.04.2025 in B.A. No.2613 of 2025. Hence, it is submitted that the petitioner be also admitted to bail.
The learned Addl. P.P. opposes the prayer for bail.
Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Rajmahal, in connection with Barharwa P.S. Case No.190 of 2024 with the condition that the petitioner will cooperate with the trial of the case and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the trial of the case with further condition that he will not annoy or disturb the informant or any of his family members in any manner during the trial of the case.
