4. This contempt petition has been filed alleging wilful disobedience of the
judgment dated 04.06.2024 passed by Writ Court in WPMS No. 3619 of 2023 and also the order dated 09.08.2024 (as corrected vide order dated 23.08.2024) passed in SPA No. 191 of 2024.
5. Learned Writ Court had allowed the writ petition and directed the University to issue necessary notification, for conferring autonomous status to petitioner college, as per Regulation 4.2 of UGC Regulations of 2023.
6. The said judgment, rendered by Writ Court, was challenged in SPA No. 191 of 2024 by the University. During the course of hearing in the said appeal, a statement was made by learned counsel for the parties that State Government has taken a decision in a meeting held on 18.07.2024, in which representatives of the affiliating University and the concerned college were also present; and
2025:UHC:1747 in view of the decision taken in the meeting, the grievance raised by the parties no longer subsists. In view of the statement made by learned counsel for the petitioner as well as learned counsel for the University, the special appeal was
disposed of in terms of Government
Order dated 06.08.2024, which was issued in view of the decision taken in the meeting held on 18.7.2024.
7. Shivalik College of Engineering has filed this contempt petition, alleging wilful disobedience of the orders passed by Writ Court and the appellate court. Since Special Appeal filed against the
judgment rendered by Writ Court was
disposed of in terms of the statement made by counsel for the parties, including the petitioner, in terms of the Government Order dated 06.08.2024, therefore, petitioner cannot raise a grievance now that the order passed by Writ Court is not being complied with; since the order passed by Writ Court has merged in the order passed in Special Appeal and the Special Appeal refers to the decision taken by the State Government, as contained in the Government Order referred to above, therefore, this Court is of the considered view that this is not a case of wilful disobedience of the order passed by this Court.
8. Mr. Jitendra Kumar Sethi, learned counsel appearing for the University makes a statement at the bar that the case of the petitioner for autonomous status was considered and rejected by the University, as petitioner college failed to meet the requirement of the policy decision taken by the Government.

9. Accordingly, the contempt petition is dismissed. Notices issued to the opposite parties are hereby discharged. However, petitioner shall be at liberty to approach appropriate forum for redressal of his grievance, if any.
