JUSTICE NARENDRA SINGH DHADDHA Order 09/01/2025 By way of this petition, petitioners-defendants (for short ‘the defendants’) have challenged the order dated 12.12.2015 passed by the Additional Civil Judge and Judicial Magistrate No.3 (North) Kota in application No. 42/1993 whereby the trial Court dismissed the application filed by the defendant for taking the document on record. Heard.
[2025:RJ-JP:1376] (2 of 2) [CW-1423/2016] Considered. While dismissing the application filed by the defendant, learned trial court posted the matter for final arguments on
17.12.2015. Heard learned counsel for the defendants and perused the impugned order. It is an admitted position that the defendants had filed the documents at a belated stage i.e. at the stage of final arguments whereas the matter was one of the oldest cases (of the year 1983) So, in my considered opinion, the trial Court had not committed any error in dismissing the application filed by the defendant. So, the present civil writ petition being devoid of merit, is liable to be dismissed, which stands dismissed accordingly.
