GP FOR HIGHER EDUCATION (AP) The Court made the following: ORDER: This Writ Petition is filed by the Petitioner seeking the indulgence of this Court under Article 226 of the Constitution of India for the following relief: “ i) to declare the action of the respondents in contemplating to retire the petitioner on attaining 58 years of age though the age of superannuation fixed under section 78A of A.P.Education Act 1982 and A.P.Admission and Fee regulatory Committee AFRC 2015 is 60 years for last grade service as illegal irregular arbitrary discrimination unconstitutional and violative of fundamental rights guaranteed under Articles 14 and 16 of Constitution of India and ii) consequently, declare that the intimation letter Ref.BEC/PF/426 dated 2.4.2019 issued by the respondents 4 and 5 intimating that the petitioner would be retired from service on 30.06.2017 on completion of 58 years of age as illegal iii) consequently, direct the respondents to continue the petitioner in service as helper in respondent No.5 institution till he attains the age of 60 years as per the above mentioned regulations.” 2 2. Learned Assistant Government Pleader appearing for respondents would submit that in the light of the interim order passed by this Court on 26.04.2019 in IA No.1 of 2019, the Petitioner attained the age of superannuation after completing 60 years and that no further orders are necessary in this Writ Petition. 3. Sri N.Bharat Babu, learned counsel for the Petitioner is in attendance. 4. In that view, the Writ Petition is disposed of. No order as to costs. Pending applications, if any, shall stand closed.
