Rarry, learned senior counsel assisted by Ms. Nikita, learned counsel appears for the respondents No. 1, 3 & 4 and Ms. Momota Oinam, learned senior counsel appears for the respondent No. 2. The learned counsel appearing for the appellant relied upon the para No. 11 of the affidavit in opposition filed by the respondents No. 1 & 4 wherein it has been stated that “it is humbly submitted that notwithstanding to the above facts, the Department is considering to re-examine the RR for the post of Section Officer (IT) Grade – I by forming a committee consisting of experts from the Department of Personnel (DP) and Finance Department (FD/PIC)” and in view of the statement made in the affidavit in opposition, he seeks disposal of the writ petition with appropriate direction to the respondents. Mr. M. Rarry, learned senior counsel submits that the aforesaid para No. 11 has strongly denied the averments of the petitioner in the writ petition. However, in para No. 11, the Additional Secretary to Government of Manipur has made statement before this Court to re-examine the RR for the post of Section Officer (IT) Grade – I. In view of the above, we are inclined to direct the respondent No. 1 to consider the petitioner’s representation dated 23.09.2019 and the same shall be referred to the expert committee as per the rules and thereafter, the respondent No. 1 shall take a decision in accordance with law. We express no opinion on the merit of the case. The exercise shall be completed within a period of 12 (twelve) weeks’ time from the date of receipt of a copy of this order.
