Heard learned Standing Counsel for the State-respondents and perused the record. 2. The instant writ petition has been filed for following relief: "(a) Issue a writ, order or direction in the nature of mandamus directing the court of Sub Divisional Magistrate, Tehsil Bairiya, District Ballia to decide the Case No. 53/24 (Comuputerized Case No.T201915090502417) (Anand Kumar and another Versus Virendra and others) as early as possible within a stipulated time as this Hon'ble Court may deem fit and proper under the facts and circumstances of the case; so that justice may be done." 3. From perusal of the writ petition and annexures annexed thereto, it appears that the aforementioned case is pending since 2024 before respondent no.2 for adjudication. 4. No useful purpose would be served in keeping this petition pending. 5. The present petition stands disposed of finally with a direction to the respondent No. 2, Sub Divisional Magistrate, Tehsil Bairiya, District Ballia to consider and decide the aforementioned case in accordance with law, expeditiously, preferably within a period of three months from the date of production of a certified copy of this order after ensuring service upon all the respondents and after giving opportunity of hearing to the parties concerned provided that there is no other legal impediment.
