The instant petition has been preferred to direct the learned City Magistrate, Gorakhpur/concerned court to decide the Case No. 2505 of 2023, Computerized Case No. D202305310002505 (State vs. Vinay Chaurasiya & Others), under Section 145 Cr.P.C., within stipulated period of time. 3. It is the case of the petitioner that the proceeding under Section 145(1) and 146 Cr.P.C. has already been taken place. Both the parties have already put their appearance in shape of preferring their objection along with the evidences, meaning thereby proceeding under Section 145(4) Cr.P.C. is still to be adjudicated by the concerned authorities. 4. In view of the aforesaid facts and circumstances, without interfering into the merit of the matter, learned concerned Sub- Divisional Magistrate/learned City Magistrate, Gorakhpur/concerned court is hereby directed to proceed with the Case No. 2505 of 2023, Computerized Case No. D202305310002505 (State vs. Vinay Chaurasiya & Others), by way of receiving the arguments/objections in shape of extending evidences and by way of extending proper opportunity of hearing and decide the matter finally in pursuance to Section 145(4) Cr.P.C., as expeditiously as possible, preferably within a period of 4 months from the date of presentation of a certified copy of this order. 5.
