The present application u/s 482 Cr.P.C. has been filed with prayer to quash the entire proceedings of Case No. 3117/9 of 2023, arising out of Case Crime No. 1056 of 2022, under Sections 323, 504 of I.P.C., P.S. Majhola, District Moradabad, as well as cognizance/summoning order dated 18.5.2023, pending in the Court of C.J.M., Moradabad. Learned counsel for the applicants submitted that impugned First Information Report dated 16.12.2022 has been lodged on the basis of false and frivolous allegations with ulterior motive and only to harass the applicant. It is further submitted that private opposite party no. 2 is wife of applicant and various matrimonial disputes are pending between the parties. It is further submitted that mediation is failed between the parties earlier to lodging of present F.I.R. After some arguments, learned counsel for the applicant does not want to press the present application. In view of above, the present application u/s 482 Cr.P.C. is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
