GUNESHWAR SHARMA ORDER 22.04.2025 [1] Heard Mr. Karung H Kom, learned counsel appearing for the petitioner and Mr. H. Samarjit, learned GA assisted by Mr. W. Niranjit, learned Dy. GA appearing for the State respondent. [2] The petitioner who is the Power of Attorney holder of the landowners affected by the construction of NH-202 at Jessami Village, Ukhrul, Manipur approached this Court with the present writ petition praying for disposal of the representation dated 16.12.2024 submitted to the Deputy Commissioner, Ukhrul, Manipur, the respondent no. 3, here in this case. [3] The petitioner earlier submitted the representation dated 24.06.2024 to the Arbitrator (Respondent no. 2) through Deputy Commissioner, Ukhrul in connection with the land acquisition for construction of NH-202 under Section 3G (5) of the NH Act, 1956. [4] It is submitted that during the pendency of the representation before the D.C., Ukhrul, the Ministry of Road Transport and Highways, Govt. of India issued a notification dated 10.10.2024, thereby, conferring the power of Arbitrator under section 3G (5) of the NH Act, 1956 to the Secretary (Fisheries), Govt. of Manipur for the revenue districts of Imphal East, Thoubal, Ukhrul, Kamjong and Kangpokpi. OINAM THOIB A MEITEI Digitally signed by OINAM THOIBA MEITEI Date: 2025.04.24 14:12:42 +05'30' [5] After the issuance of the said notification dated 10.10.2024, the petitioner submitted a representation dated 16.12.2024 to respondent no. 3 for forwarding the earlier representation dated 24.06.2024 to the newly appointed Arbitrator i.e. Secretary (Fisheries), Govt. of Manipur. [6] The learned counsel for the petitioner submits that the writ petition can be disposed of by directing the respondent no. 3 to forward the earlier representation dated 24.06.2024 to the newly appointed Arbitrator. [7] The learned GA for the State respondents submits that this Court may pass an appropriate order. [8] Recording the submissions made at the bar, the present writ petition is disposed of by directing the respondent no. 3 (D.C., Ukhrul, Govt. of Manipur) to forward the representation dated 24.06.2024 to the newly appointed Arbitrator i.e. Secretary (Fisheries), Govt. of Manipur for deciding the matter within a period of 1(one) month from the date of receipt of a copy of this order.
