The proposed Revision has been filed under Section 25 of the Provincial Small Cause Courts Act, 1887 against the judgment and decree dated 30.07.2024, passed by learned Judge, Small Causes Court/Ist Additional District Judge, Roorkee, District Haridwar in SCC Suit No.31 of 2018, by which, the learned Judge has directed the revisionist-defendant to hand over the peaceful possession of the suit property to the respondents-plaintiffs within two months. Learned Judge has further directed to pay the outstanding rent of three years at the rate of Rs.650/- 1 2025:UHC:5634 per month within two months and further to pay Rs.25/- per day till the possession is handed over. 2. The affidavit dated 23.11.2024, filed by the revisionist, is taken on record. 3. Heard Mr. R.P. Singh, learned counsel for revisionist and Mr. Anshu Kumar, learned counsel for respondents. 4. The revisionist has sought one year period from 04.11.2024 to vacate the suit property. He has also sought six months’ period to pay the entire outstanding rent. 5. The respondents agree with the said proposals. 6. On the request of both the parties, the present Revision (CLR No.87 of 2024) is disposed of at the admission stage directing the revisionist-defendant to hand over the peaceful possession of the suit property to the respondents-plaintiffs within a period of one year from 04.11.2024. He is further directed to pay the entire outstanding rent, as directed by the trial court, within six months from today and pay the mesne profits at the rate of Rs.25/- per day till the possession of the suit property is handed over.
