This Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed for quashing the entire proceedings of Criminal Case No.483 of 2023 (Old No.6181 of 2020), “State vs. Rohit”, pending before the court of Additional Chief Judicial Magistrate/ Ist Additional Civil Judge (Senior Division), Haridwar under Sections 323, 504, 506 of the Indian Penal Code, 1860, Section 3 and Section 4 of the Dowry Prohibition Act, 1961. 1 2025:UHC:7775 2. Heard Mr. Navneet Kaushik, learned counsel for the applicant, Mr. Pratiroop Pandey, learned Assistant Government Advocate for the respondent no.1 and Ms. Sheetal Selwal, learned counsel for the respondent no.2/informant. 3. Mr. Rohit Kumar is present through video conferencing. He is identified by Mr. Navneet Kaushik, Advocate. 4. The respondent no.2- Smt. Rakhi is present through video conferencing. She is identified by Ms. Sheetal Selwal, Advocate. 5. The applicant and the respondent no.2 submitted that they have settled their matrimonial disputes. They have filed a Compounding Application (IA No.1 of 2025) and affidavits with their free will and without any pressure. The respondent no.2 has requested to quash the entire proceedings of Criminal Case No.483 of 2023 (Old No.6181 of 2020). 6. Learned counsel for the State submitted that the private parties have settled their matrimonial disputes. 2 2025:UHC:7775 7. Considering the totality of the matter, this Court is of the view that ends of justice would be met if the entire proceedings of Criminal Case No.483 of 2023 (Old No.6181 of 2020), “State vs. Rohit”, pending before the court of Additional Chief Judicial Magistrate/ Ist Additional Civil Judge (Senior Division), Haridwar, are quashed. 8. Resultantly, the present Application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is allowed and the entire proceedings of Criminal Case No.483 of 2023 (Old No.6181 of 2020), “State vs. Rohit”, pending before the court of Additional Chief Judicial Magistrate/ Ist Additional Civil Judge (Senior Division), Haridwar, are hereby quashed. ___________________ Date: 02.09.2025 ALOK KUMAR VERMA, J.
