Order 28/04/2025
Learned counsel for the petitioner submits that a suit for Partition, Declaration and Permanent Injunction has been filed in the Court of Sub-Divisional Officer, Amer wherein petitioner is respondent No.2. It is submitted that petitioner has already attained the age of 75 years. Counsel submits that proceedings
[2025:RJ-JP:17890] (2 of 2) [CW-5036/2025] before the learned trial court is going at snail’s pace and it appears that there is no immediate prospect of this suit being decided in near future. Counsel thus, prays that in these circumstances, learned trial court may be directed to expedite the proceedings. Learned counsel contends that presently, matter is pending for recording evidence of the plaintiff. Considering the limited prayer made by learned counsel for the petitioner as also considering the age of the petitioner, I deem it just and proper to direct learned Sub-Divisional Officer, Amer to expedite the proceedings and make all endeavors to conclude the trial on or before 30.06.2025. With the aforesaid directions, this writ petition is disposed of.
