This writ petition has been filed for the following relief: "i. issue a writ, order or direction in the nature of certiorari quashing the order dated 29-08- 2024 passed by respondent no. 2 in Appeal no. 437 of 2022 bearing its computerized case no. C202205000000437 (Dhiraj Singh Vs. Ram Niranjan Singh & others), under section 331(3) of U.P.Z.A. & L.R. Act, 1950, (which is annexure no. 4 to the writ petition)." 4. By the order impugned dated 29.08.2024, the stay application filed by the petitioner, in an appeal filed under Section 331(3) of U.P.Z.A. & L.R. Act, 1950 against an order passed in proceedings under Section 176 of U.P.Z.A. & L.R. Act, 1950, has been rejected. Against the order impugned, the writ petition itself has been filed after 3 months and after filing more than six months have passed. No useful purpose would be served in keeping this petition pending. 5. Accordingly, the writ petition is disposed of with direction to respondent No. 2- Additional Commissioner (Administrative)-III, Gorakhpur Mandal, Gorakhpur to consider and decide the Appeal No. 437/2022, Computerized case no. C202205000000437 (Dhiraj Singh Vs. Ram Niranjan Singh & others), in accordance with law, expeditiously, preferably within a period of six months from the date of production of a certified copy of this order, if not already decided, after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided there is no other legal impediment.
