1. Challenge in this writ petition is to the attachment order No. 654/2024 dated 23.12.2024 passed by respondent No. 3 by which, petitioner has been posted in Surguja range for three months looking to medical condition of petitioner.

Facts of the case, in a nutshell, is that the petitioner was appointed in Chhattisgarh Police Department in the year 1996 and posted in different Police Station, however, the petitioner was posted as ASI in the Police Station, Gandhi Nagar since 2022 to November, 2024. Thereafter, the petitioner was transferred to Police Station Darima vide order dated 05.11.2024. Due to some false allegation, petitioner was subject to suspension vide order dated 01.10.2024 and vide order dated 05.11.2024, suspension
order has been revoked. Thereafter, order No. 599/2024 was passed vide order dated 26.11.2024 by Chairman Range Police Establishment Board / Inspector General of Police, Surguja Range, Ambikapur transferring petitioner from Police Station Darima Distt. - Surguja to Distt. - Balrampur – Ramanujganj. Petitioner submitted representation before respondent No. 3 which was decided vide impugned order No. 654/2024 dated 23.12.2024 attaching the petitioner to Distt. - Surguja Range for a period of three months.
3. Learned counsel for petitioner submits that petitioner has been transferred from Distt. - Surguja to Distt. - Balrampur – Ramanujganj. Upon representation, on the ground of his medical condition, representation was considered and petitioner was attached vide order dated 23.12.2024 at Distt. - Surguja. According to petitioner, said order is going to expire as three months period is about to complete and therefore petitioner has moved application / representation. Earlier also, petitioner has moved a petition for quashment of his transfer order in which this
3 Court has directed the petitioner to file representation before concerned authority. The concerned authority considered the same and the petitioner was attached for a period of three months at Distt. - Surguja. Attachment of petitioner to Distt. - Surguja is going to expire and thus, petitioner is praying for reconsidering the same and to extent the period of attachment. Age of petitioner is about 59 years and he is suffering from various ailment. Wife of petitioner is also facing health problems, as such, on this ground, petitioner is praying for a direction to the authorities to reconsider the case of petitioner and to pass appropriate order with respect to posting of petitioner as per his representation.
4. Considering facts and circumstances of the case, respondent authorities, who have passed earlier order dated 21.12.2024 are
directed to consider case of petitioner in a pragmatic manner, looking to the fact that petitioner is suffering from various ailment , his treatment is going on and his wife is also not fit due to health issues. Since period of attachment is going to expire, it is expected from the respondent authorities to decide the matter before completion of the said period and to pass appropriate order in this respect.
5. With the aforesaid observation and direction, this petition stands
disposed of.
