Pursuant to the order dated 13.05.2025, respondent No.2 – Commissioner of Police is present before the Court and appraise about the efforts, which have been made to trace the daughter of the petitioner. - 3 - NC: 2025:KHC-K:2717-DB WPHC No. 200010 of 2025 3. This petition is filed under Articles 226 and 227 of the Constitution of India in the nature of Habeas Corpus Petition, with a prayer to trace the minor kidnapped girl Kum. Shilpa and to produce before this Court. It is also forthcoming from the complaint dated 28.12.2024 (Annexure-B) that, daughter of the petitioner has been kidnapped by one Nagendra S/o. Narayanaswamy of Kurubarhalli Village, Chintamani taluka, Chikkaballapur district. 4. With this aspect of the matter, we have carefully considered the affidavit filed by one Sri Subashchandra, working as Assistant Sub Inspector, University Police Station, Kalaburagi, wherein, it is stated that, alleged Nagendra is in Judicial Custody. In that view of the matter, since the respondent – authorities have taken steps to trace the missing daughter of the petitioner herein and as such, we are of the view that the petition be closed with a direction to respondent No.2 to file periodical report before this Court with regard to the efforts made to - 4 - NC: 2025:KHC-K:2717-DB WPHC No. 200010 of 2025 trace the missing girl. Such report shall be filed once in two months from today before this Court after serving copy to the petitioner herein and disclose about the efforts made with regard to tracing of missing daughter of the petitioner. In that view of the matter, writ petition is disposed off. It is also made clear that the petitioner shall cooperate with the Investigating Officer to trace her missing daughter and also provide details to him for early action.
