For Petitioner : Mr.V.Velmurugan ORDER The petitioners seek Succession Certificate in favour of the 1st petitioner in respect of the securities held by Late Mr.Shankarlal Jalan, who died intestate on 06.01.2023. The petitioners 1 to 3 are the only legal heirs of the deceased. 2. The first petitioner has been examined as PW1, he has produced 8 documents to support his deposition which are listed as Ex.P1 and Ex.P8 at the foot of the order. O.P.No.623 of 2024 as Ex.P1. A perusal of Ex.P1 clearly substantiates that the petitioners 1 to 3 are the only legal heirs of the deceased. The consent affidavits of the 2nd and 3rd petitioners expressing their consent to grant the succession certificate in favour of the 1st petitioner has been filed along with the petition. A paper publication has been effected which is marked as Ex.P8 and no objections have been received. 3. The assertions in the petition have been duly proved by adducing oral evidence supported by documents. In these circumstances, the 1st petitioner is entitled to the relief. 4. In view of the above evidence, the Original Petition is allowed granting Succession Certificate in favour of the 1st petitioner, with the power to collect the securities and to receive the interest and dividends thereon and negotiate and transfer the securities mentioned in the schedule to the petition.
