Apprehending his arrest, the petitioner, namely, Dildar Ali Shekh @ Dildar Ali Sheikh, son of Samed Ali, resident of Village-Tulsinagar, Chamata Pathar, P.O. & P.S. Sonapur, District-Kamrup (Metro), has filed this application on 08.04.2025 under Section 482 BNSS, 2023, seeking pre-arrest Page No.# 2/3 bail in Sonapur Police Station Case No. 33/2025 registered under Sections 13/14/15 of the Assam Game and Betting Act, 1970 corresponding to G.R. No. 800/2025. 3. By order dated 06.05.2025, the petitioner was granted interim bail in said Sonapur P.S. Case No. 33/2025. 4. Perused the case diary placed before the Court today by Mr. Borthakur, learned Additional Public Prosecutor, Assam. 5. Mr. Borthakur, learned Additional Public Prosecutor, Assam from the case diary submitted that the petitioner after obtaining interim bail appeared before the concerned Investigating Officer of Sonapur P.S. Case No. 33/2025 on 10.05.2025 and his statement has already been recorded. 6. Mr. Borthakur, learned Additional Public Prosecutor, Assam, from the case diary further submitted that though there are materials against the petitioner, he is co-operating with the investigation of the case as of now. 7. Considering such materials in the case diary, the Court is of the view that custodial detention of the petitioner, named above, is not warranted to investigate the said Sonapur P.S. Case No. 33/2025. As such, this pre-arrest bail application of the petitioner is accepted. 8. The petitioner, namely, Dildar Ali Shekh @ Dildar Ali Sheikh is already on interim bail in said Sonapur P.S. Case No. 33/2025 granted to him earlier by this Court on 06.05.2025 and the same is hereby made absolute, subject to the full compliance of the terms and conditions as specified in the said order dated 06.05.2025 and further, on compliance of the following conditions that the petitioner – (i) shall appear before the concerned Investigating Officer of said Sonapur P.S. Case No. 33/2025 as and when he is required for necessary investigation of the case; (ii) shall not leave the territorial jurisdiction of said Sonapur Police Station, without obtaining prior written permission from the concerned I/O of the case; (iii) shall not hamper with the investigation, or tamper with the evidence of the case; (iv) shall not involve himself in any criminal activities in future. Violation of any of the aforesaid terms and conditions as well as the terms and conditions specified in the said order dated 06.05.2025, noted above, the pre-arrest bail granted to the petitioner, Dildar Ali Shekh @ Dildar Ali Sheikh in said Sonapur P.S. Case No. 33/2025 shall stand automatically vacated. 10. Accordingly, this pre-arrest bail application stands disposed of. 11. Return the case diary. JUDGE Comparing Assistant
