PUBLIC PROSECUTOR The court made the following Order: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioners/A1 and A2, seeking regular bail, in Crime No.216 of 2024 of Kirlampudi Police Station, Kakinada District. 2. A case has been registered against the petitioners herein for the offence punishable under Section 20(b)(ii)(C) read with 8(c) of the NDPS Act. 3. Case of the prosecution, in brief, on 25.11.2024, on receipt of credible information, the Sub-Inspector of police along with his staff and mediators rushed to NH-16 road, somavaram village, kirlampudi and found the accused in possession of 2 163.545Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report. 4. Heard. Perused the record. 5. Learned counsel for the petitioners contends that the petitioners have been in judicial custody from 25.11.2024 and prays to grant bail to the petitioners herein. 6. On the other hand, learned Assistant Public Prosecutor opposed to grant bail on the ground that contraband allegedly involved in the present crime is 163.545Kgs of Ganja, which is a commercial quantity. He further submits that six criminal antecedents have been reported against the petitioners. 7. In view of the gravity of offence and involvement of huge quantity of ganja and in view of the bar contained under Section 37 of the NDPS Act, this Court is not inclined to grant bail to the petitioners. 8.
