Petitioners are aggrieved by a communication dated 31.07.2025, issued by Examination Controller of Veer Madho Singh Bhandari Uttarakhand Technical University, Dehradun. By the said communication, Director / Principal of all affiliated colleges were told to permit only such students in the semester examination, scheduled to be held in the second week of August, 2025, who have fulfilled the norms regarding attendance. 4. Since petitioners’ attendance falls short of the prescribed norms, therefore, they have approached this Court. 5. Learned counsel for the petitioners submits that although attendance of some of the petitioners is substantially less than what is required, however, there are others, whose attendance falls short by only 2-3 percent, therefore, all petitioners cannot be treated in similar manner, as it would amount to treating unequals as equal. 2025:UHC:7863 6. Learned counsel for the petitioners has referred to Clause 28 of the Ordinance of the University for B. Tech. Programmes, for contending that academic council has the power to amend/relax any provision provided in the Ordinance. 7. Having regard to the facts and circumstances of the case, the writ petition is disposed of by permitting the petitioners to approach the Competent Authority in the University, by making representation. If they make representation within one week from today, the competent authority shall take decision thereupon, as per law, within two weeks thereafter. 8.
