SREENIVASA REDDY Criminal Petition No.2688 of 2025 Order: This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/Al and A2, seeking anticipatory bail, in connection with Crime No.27 of 2025 of Prohibition and Excise Station, Rajamahendravaram-North, East Godavari district. 2. A case has been registered against the petitioners herein for the offence punishable under Section 7-B read with 8-A and 8-B of the A.P. Prohibition (Amendment) Act, 2020. 3. Case of the prosecution is that on 05.02.2025, at about 02.30 PM, the ESTF Sub-Inspector of Police, Prohibition and Excise Station, Rajamahendravaram-North, along with his staff, proceeded to Thurpu Gattu of Gurrala Cheruvu located at Kolamuru village of Rajamahendravaram Rural mandal and found two persons stirring with sticks in plastic drums. On seeing the raid party, they ran away from the spot. The police verified the scene and found 1500 litres of FJ Wash in 9 plastic drums, which was fit for distillation of ID liquor. The police identified the persons ran away as accused. After collecting samples, the police destroyed the drums with remaining FJ V 2 Wash under cover of a special report and registered a case against the accused. Heard. Perused the record. 4. A perusal of the material on record goes to show that no 5. contraband is seized from the possession of the accused, and based on the particulars mentioned in the special report, the petitioners herein have been arraigned as accused in the present crime. Learned Additional Public Prosecutor submitted that most of the investigation has been completed. In view of the aforesaid facts and circumstances of the case. 6. this Court is inclined to grant anticipatory bail to the petitioners herein on the following conditions. i) In the event of arrest of the petitioners herein in the aforesaid crime, they shall be enlarged on bail on their executing personal bonds for a sum of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like sum each to the satisfaction of the concerned Arresting Officer. ii) Petitioners shall cooperate with the investigation and they shall make themselves available for interrogation by a police officer as and when required, and they shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the 3 facts of the case so as to dissuade him from disclosing such facts to the Court or to any poiice officer. iii) Petitioners shall appear before the Station House Officer concerned once in a week i.e. on every Sunday between 10.00 AM and 1.00 PM, till filing of the charge sheet. The Criminal Petition is, accordingiy, allowed. 7. As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition, shali stand closed. Sd/- P.U.V.
