This appeal arises out of impugned judgment dated 30.08.2005 passed by learned 4th Additional Sessions Judge (FTC), Ambikapur, District Surguja (C.G.), in Sessions Trial No.466/2004. As per bailable warrant dated 21.01.2025, a report dated 10.03.2025 received from Police Station Kotwali, Ambikapur District Surguja (C.G.), wherein, it has been informed that appellant Palu Ram @ Palu died of illness 5 years ago. As regards the death of the Appellant, a Panchnama was prepared and entry in Rojnamcha was made by Police Station Ambikapur which are also annexed with the said report. 3. Learned Counsel appearing for the State recorded ‘no objection’ in this regard. 4. In view of above, as sole appellant Palu Ram @ Palu S/o Ramsai died, and no representation has been made for bringing legal heirs of the sole appellant on record, therefore, this appeal is dismissed as having abated.
