Applicant-Accused-Kuldeep Kumar Saroj has filed this petition under Section 407 Code of Criminal Procedure for transfer of Criminal Case No. 4490 of 2022; titled State vs. Kuldeep Kumar Saroj, arising out of Case Crime No. 43 of 2022, under Sections 498A, 323, 504, 506 IPC and Section 3/4 Dowry Prohibition Act, Police Station Puramufti, District Prayagraj pending before Additional Chief Judicial Magistrate, Prayagraj to any other court of competent jurisdiction at Kaushambi. No one has appeared on behalf of the applicant-accused. The prayer in the petition has been made for transfer of the case bearing Criminal Case No. 4490 of 2022 pending adjudication in the court of Additional Chief Judicial Magistrate, Prayagraj to a court of competent jurisdiction at Kaushambi, wherein the applicant is the sole accused. The applicant has sought for transfer of the case for his own convenience, and in the absence of any exceptional ground, this Court is not inclined to accept the prayer, as the distance between two towns is nearly 40 kms. The application fails and is hereby dismissed.
