Neutral Citation No. - 2025:AHC:17738 Court No. - 49 Case :- WRIT - B No. - 4487 of 2024 Petitioner :- Smt Upma Devi Respondent :- State Of Up And 3 Others Counsel for Petitioner :- Rajesh Kumar Dubey Counsel for Respondent :- C.S.C. Hon'ble J.J. Munir,J. Heard learned counsel for the petitioner, Sri Rajesh Kumar Dubey, in support of the motion to admit this petition to hearing at length and Mr. Ashutosh Kumar Rai, learned Additional Chief Standing Counsel for the State. The petitioner has challenged the order dated 08.07.2024 passed by the Revenue Officer, Madawara, Tehsil-Madawara, District- Lalitpur, by which he has declined an application to demarcate land comprising Plot Nos. 301, 894, 917 and 902 in the exercise of powers under Rule 109 for the purpose of delivering possession. The Consolidation Officer has refused to demarcate for the purpose of delivery of possession in view of the fact that in Writ-B No.1909 of 2022, which arises out of objections under Section 9- A(2), this Court has passed an interim order directing that parties shall not create any third party rights over the property in dispute. The said interim order is continuing. There is a further relief sought in the nature of a mandamus seeking a direction to the authorities to demarcate the land which is again in the aid of securing possession, given the fact that the title dispute inter se parties arising out of objections under Section 9-A(2) is pending before this Court where an interim injunction, may be restraining parties from alienating the property in dispute,
is pending. No exception can be taken by the petitioner to the orders made by the Consolidation Officer, Lalitpur refusing to demarcate land subject matter of dispute. It is open to the parties to suit their rights in Writ-B No.1909 of
2022. There is no force in this writ petition, which is, summarily, dismissed. Let Writ-B No.1909 of 2022 be de-tagged and listed on schedule. Order Date :- 6.2.2025 Ashutosh Digitally signed by :- ASHUTOSH SINGH High Court of Judicature at Allahabad
