This Writ Petition is filed under Article 226 of the Constitution of India for the following relief/s:-
“…to issue an order writ or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents initiating disciplinary proceedings against the petitioner repeatedly targeting him in
order to remove his name from Zone of Consideration for promotion to State Post by issuing initiation of inquiry proceeding vide Memo.No.ESE02-12021/30/2025-EST2-CSE Dated 10.02.2025 and Rc.No.212-A1/2025 Dated 22.02.2025 is illegal and arbitrary being in violation of Article 14 and 21 of the constitution of India and direct the respondents to withdraw/cancelled the initiation of inquiry proceeding vide Memo.No.ESE02-12021/30/2025-EST2-CSE Dated 10.02.2025 and Rc.No.212-A1/2025 Dated 22.02.2025 against the petitioner and not to

make any entries in service register with regards to Departmental Proceedings and consider his name on merits for promotion to State Post and pass such other order or orders.…”
2. Heard Sri Pamarthy Rathnakar, learned counsel for the petitioner and learned Assistant Government Pleader for Services-II appearing on behalf of the respondents.

Learned counsel for the petitioner submits that the petitioner has been victimized and with the repeated inquiries only to deny the fair opportunity of promotion and growth in career even on earlier occasion he was issued a charge memo on allegations of acquiring assets, without even verifying that the acquisition of said assets was with post facto sanction of the competent authority, considering the same this Court in W.P.No.29530 of 2024 suspended the said charge memo. Yet again by proceedings dated 22.02.2025, another inquiry is sought to be made against petitioner on certain wild allegations.

Learned Assistant Government Pleader placed on record written instructions dated 11.03.2025, stating that as of now no disciplinary action is initiated against the petitioner or contemplated at this stage, by the proceedings dated 22.02.2025 merely proposed to inquire into the allegations made against the petitioner in pursuance to one of the complaints received against the petitioner.
5. Having regard to the statement made above, that no disciplinary action is contemplated against the petitioner at this stage, recording the same, the

writ petition is closed, however, granting liberty to the petitioner to initiate appropriate proceedings in case the preliminary inquiry culminates into disciplinary action.
6. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
As a sequel, miscellaneous applications, pending if any, shall stand closed. ______________________________
