Heard the learned counsel for the petitioner and the learned standing counsel for the C.B.I. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as A.11 in C.C. No.3 of 2022 on the file of the Special Judge for C.B.I. cases, Kurnool, for the alleged offences under Sections 120-B read with Sections 420, 468, and 471 of the Indian Penal Code, 1860 (hereinafter referred to as ‘I.P.C.’). The learned counsel further submits that the case was transferred to the Special Judge for C.B.I. cases, Kurnool and that the petitioner has filed a discharge petition, which has been pending for the past one year. The learned counsel also submits that the petitioner is not involved in the commission of the alleged offences under Sections 120-B read with Sections 420, 468, and 471 of the I.P.C. 3. When the matter is taken up for hearing, the learned standing counsel for C.B.I. submitted that the petitioner had already filed CrI.P. No.4909 of 2022 before this Court, seeking to quash the case under Section 13(2) read with Section 13(1)(d) of the Prevention of CorruptionAct and Section 120-B read with Sections 420, 468, and 471 of I.P.C. This Court, vide order dated 16.08.2022, partly allowed the criminal petition. holding that the petitioner is not an employee of the State and is V considered as a private person. Consequently, this Court directed that proceedings before the Special Judge for C.B.I. cases continue only for the I.P.C. sections and discharged the petitioner under Sections 13(2) read with Section 13{1)(d) of the Prevention of Corruption Act, 1988. The learned counsel for the petitioner submits that the petitioner is a 67 years old person and has to travel for Kurnool on every date of hearing. Considering the same, there shall be stay of appearance of the petitioner subject to filing an undertaking before the learned Special Judge for C.B.I. cases, Kurnool, to appear before the Court as and when required and directed for the purpose of trial in connection with 4. 5.
