Pandey Advocate For Respondent : Ms. Neelam Singh Thakur, Panel Lawyer Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 22.07.2025 1) Heard on admission. 2) The petitioner has filed this petition seeking the following relief(s):- ”10.1 That, this Hon'ble court may kindly be pleased to restrain the respondent authorities to not make any construction/not make any other activities / not dispossess the petitioner from the subject land till the decision of the final decision of the application for grant of Van Adhikar Patta of the subject land of petitioner. 10.2 That, this Hon'ble court may kindly be pleased to direct the respondent authorities to consider/ decide the application of the petitioner for grant of Van Adhikar Patta of the subject land of petitioner as early as possible. 10.3 That, any other relief or reliefs may also be granted to the petitioner which this Hon'ble court deems fit and proper in the facts and circumstances of the case.” 3) Learned counsel for the petitioner submits that the petitioner had moved an application in the year 2013 for grant of Van Adhikar Patta in respect of Survey No. P-3442, admeasuring 106.10 hectares, situated at Village Kanakpur, Tehsil Ramanujganj, District Balrampur, however, the said application has not been -3- decided till date; thus, he prays for issuance of a direction to respondent authorities, particularly respondents No. 3 and 7, to consider and decide the pending application. 4) Taking into consideration the limited prayer made by learned counsel for the petitioner, the petition is disposed of with liberty to the petitioner to file a fresh application/representation before the competent respondent authorities. In turn, the said authorities are directed to consider and decide such application/representation, in accordance with law, preferably within a period of 150 days from the date of receipt of such application. 5) Accordingly, the writ petition stands disposed of at the admission stage itself. 6) It is made clear that this Court has not expressed any opinion on the merits of the case.
