Present C528 application is filed with the prayer to quash the summoning order dated 03.08.2024, passed in Criminal Case No. 1979 of 2024, Sanjeev Kumar vs. Mavreet Kaur, under Section 138 of the Negotiable Instruments Act, 1881, pending before learned Additional Chief Judicial Magistrate, Kashipur, District Udham Singh Nagar. 3. The arguments which has been advanced by the learned counsel for the applicant cannot be considered, at this stage. As to whether the cheque was willfully lost or misplaced by the applicant, is a fact, which can be considered by the learned Trial Court after appreciating the evidence produced by the parties before learned Trial Court. This Court while sitting in inherent jurisdiction cannot sift the evidence. Disputed facts cannot be examined in the Court exercising jurisdiction u/S 528 of BNSS, 2023 .
