The instant writ petition has been filed by the petitioner with the prayer to stay the effect and operation of the impugned order dated 16.04.2024 passed by Chief Judicial Magistrate, Rampur in Criminal Case No. 1127 of 2009 (State Vs. Shakib Hasan Khan), under Sections 420, 467, 468, 471 I.P.C., Police Station Civil Lines, District Rampur as well as order dated 04.10.2024 passed by Special Judge (E.C. Act)/ Additional Sessions Judge, Rampur. Vide order dated 03.07.2025, learned Additional Government Advocate was directed to seek instructions in the matter as to whether the charges have been framed or not. In pursuance of order dated 03.07.2025, learned AGA has filed compliance affidavit. As per para 3 of the compliance affidavit learned Chief Judicial Magistrate, Rampur vide order dated 24.01.2025 famed charges against the petitioner under Sections 420, 467, 468, 471 I.P.C. On the aforesaid premise, he contends that the instant writ petition requires no interference by this court and is liable to be consigned to the record. In view of the above facts and circumstances this Court finds that once charges have been framed, plea of discharge becomes infructuous.
