1. Learned counsel appearing for both the sides are ad idem that the controversy raised in this petition is covered by various judgments of this Court, including the judgment passed in WP(C) No. 2416/2024 clubbed with WP(C) No. 3034/2024, decided on 4th April, 2025 titled “Sita Ram & Ors. Vs. UT of JK & Ors”.
2. It is submitted that the judgment passed by this Court in LPA No. 119/2022 titled “UT of JK & Ors Vs. Deshbir Singh & Anr.” dated 22nd September, 2023, which stands upheld by the Hon’ble Supreme Court, by dismissal of SLP (Civil) Diary No. 18074/2024, titled “UT of JK & Ors Vs. Desbhir Singh & Anr.” has already set the issue raised in this petition at rest.
3. In view of the aforesaid, this petition is disposed of in terms of the
judgment passed in Desbhir Singh & Anr. (supra), and a direction is issued to the petitioners to release the amount of recovery, if any, made from the respondent, Ambir Bhat, forthwith, and, in any case, within a period not exceeding two months from the date of receipt of a certified copy of this order. The petitioners shall be well within their right to Arif Hameed I attest to the accuracy and authenticity of this document 28.12.2025
correct the error and re-fix the post retiral benefits, including the pension, if any, by withdrawing the benefit of SRO-59 of 1990.
