The petitioner has been made accused in connection with Kamdara P.S. Case No. 48 of 2021, S.T. Case No.259 of 2022, for the offence under Section 302 of the Indian Penal Code, pending in the court of Sri Prem Shankar, learned Additional Sessions Judge-I-cum-Special Judge, Gumla, Jharkhand. On 18.10.2021, there was some altercation between the petitioner and the deceased for theft of paddy. Petitioner is alleged to have given a lathi blow upon the head of the deceased, due to which, she succumbed to her injuries. It was submitted that even assuming the allegation to be true, prima facie case under Section 105 of the B.N.S. will be made out. It was further submitted that petitioner is in custody since 26.10.2021. In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Prem Shankar, learned Additional Sessions Judge-I-cum-Special Judge, Gumla, Jharkhand, in connection with Kamdara P.S.
