Through the instant petition, specific prayer has been made with regard to decide the trial of Session Trial No.773 of 2023 (State vs. Adesh and Others) arising out of Case Crime No.59 of 2020, under sections 147, 148, 149, 307 I.P.C., Police Station- Knowledge Park, District- Gautam Budh Nagar, pending before learned court of Additional District Judge 5th, Gautam Budh Nagar, within stipulated period of time. 3. At the very outset, learned counsel for the petitioner submitted that the Investigating Officer has submitted the charge-sheet on dated 02.07.2020, whereupon cognizance has been taken up by learned court concerned on 31.07.2022 and the accused persons have been summoned, since then the case is pending for even framing of charges; on account of the same, petitioner is suffering from irreparable loss. 4. Learned A.G.A. has no objection over the prayer as made by learned counsel for the petitioners. 5. Considering the innocuous prayer made by learned counsel for the petitioners and without interfering into the merits of the matter, if there is no legal impediment, learned court concerned is hereby directed to proceed for framing of charges as expeditiously as possible preferably within a period of two months from the date of production of certified copy of this order, by way of affording proper opportunity of hearing to all concerns. 6. The instant petition stands disposed of accordingly. 7. However, it is made clear that prayer for expeditious disposal of the trial shall be open before the petitioner at appropriate stage.
