[2025:JHHC:12595] IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No.3272 of 2025 ------ Vikash Sao son of Devnarayan Sao aged about 30 years, resident of Village Barikhap PO & P.S. Bariyatu, District Latehar .... .... …. Petitioner Versus The State of Jharkhand .... .... .... Opposite Party ------ CORAM : HON'BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Prashant Kr. Rahul, Advocate For the State : Ms. Kumari Rashmi, Addl.P.P ------ Order No.02 Dated- 28-04-2025 Heard the parties. The petitioner has been made accused in connection with Balumath P.S. Case No.12 of 2025 registered under Section 111 (3), 111 (4), 308 (4), 308 (5), 61 (2) (b) of the B.N.S., 2023 and Section 25 (1-B) (a), 26, 35 of the Arms Act. Learned counsel for the petitioner files a supplementary affidavit. Let the same be kept in the record. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in committing organized crime and was involved in extortion and one country-made pistol loaded with one live cartridge was recovered from the petitioner and the petitioner belongs to the gang of Aman Sahu & Rahul Singh. It is submitted that the allegation against the petitioner is false. It is further submitted that no incriminating article has been recovered from the possession of the petitioner. It is next submitted that the petitioner has been in custody since 02.02.2025. Hence it is submitted that the petitioner be released on bail. Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that keeping in view the involvement of the petitioner in organized crime as well as the criminal antecedent of the petitioner, there is every chance of the petitioner absconding and tampering with the evidence if released on bail. It is also submitted that the petitioner is a threat to the law-and-order situation in the locality. It is, therefore, submitted that the petitioner ought not be released on bail at this stage. Considering the serious nature of allegation against the petitioner, his criminal antecedent as well as his being a threat to the law-and-order situation in the locality as also his chance of absconding and tampering with the evidence, this Court is of the considered view that this is not a fit case where the above-named petitioner be released on bail. Accordingly, the prayer for bail of the above-named petitioner is rejected. (Anil Kumar Choudhary, J.) Animesh/
