Parasar, learned Addl. Public Prosecutor. This is an application for release of the petitioner on bail in connection with Page No.# 2/3 Agamoni P.S Case No. 12/2025 (Corresponding to G.R Case No. 129/2025) under Section 13(1) of the Assam Cattel Preservation Act, 2021. The FIR dated 27.01.2025 reflects that on the same date one Shri Ranjit Adhikary informed that the petitioner had loaded 200 kgs of suspected beef in a four wheeler car on its way to Dhubri from Bengal side for selling thereof. It is further reflected in the FIR that the local people intercepted the vehicle and during the same, the driver of the vehicle locked the car with the meat inside and fled and that thereafter, the local people broke the windshield and rear glasses and subsequently, the police was informed and the case was registered as Agomani P.S Case No. 12/2025 under Section 13(1) of the Assam Cattle Preservation Act. Mr. R. Islam, learned counsel for the petitioner submits that the bail petition was moved before this Court and the Court allowed the petitioner to go on interim bail vide order dated 14.05.2025 with various conditions along with the same. Thereafter, the petitioner in compliance of the said conditions went and gave his statement before the Investigating Officer on 21.05.2025. Mr. K.K. Parasar, learned Addl. Public Prosecutor submits that charge sheet vide C.S No. 77/2025 dated 30.06.2025 has been submitted. In view of the fact that the petitioner had gone and given his statement to the Investigating Officer and has complied with the conditions provided for in the Page No.# 3/3 bail order dated 14.05.2025, this Court makes the said order absolute. The petitioner may be allowed to go on bail in the event of his arrest by furnishing a bail bond of Rs. 20,000/- with two (2) local sureties of the like amount to the satisfaction of the Trial Court under the following conditions:- (1) He shall cooperate with the investigation and appear before the Court as and when he is required. (2) He shall not tamper with the evidence or influence the witnesses whoever is connected with the case. (3) He shall not leave the jurisdiction of the Investigating Officer without his leave.
