SREENIVASA REDDY Criminal Petition No.2657 of 2025 Order : This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners herein/A5 and A14, seeking anticipatory bail, in connection with Crime No.1154 of 2023 of Nallapadu Police Station, Guntur district. 2. A case has been registered against the petitioners herein and others for the offences punishable under sections 419, 420, 468, 471, 467 and 120-B read with 34 IPC. 3. Case of the prosecution, in brief, is that the de facto complainant is the GPA holder of one Venigalla Praveen. Venigalla Praveen purchased a site in an extent of 1,396 Sq.yds in the year 1998. Subsequently, Accused No.1, by colluding with other accused and officials, created fake death certificates of Venigalla Praveen, who is residing in U.S.A and his wife Sesha Rathnam and family member certificate also. Pursuance of those fake documents, Accused No.1 executed certain documents regarding the property to other accused, who in turn executed documents in favour of others. 2 4. Heard. Perused the record. 5. A perusal of material on record, prima facie, discloses that all the accusations are directed as against accused No.1 that she is alleged to have created fake death certificates of Dr. Venigella Praveen and sold away the immovable property standing in his name, to several persons under various registered sale deeds. Petitioner No.1/A5 is the GPA holder of A1 and petitioner No.2/A14 is the purchaser of the property believing that the said property belongs to accused No.1. The present case is squarely covered by the decision reported in Md. Ibrahim and others vs. State of Bihar and another1. In view of the above facts and circumstances, it is a fit case to grant pre- arrest bail to the petitioners/A5 and A14. 6. Accordingly, in the event of their arrest in the above crime, the petitioners/A5 and A14 shall be released on bail on their executing personal bonds for a sum of Rs.10,000/- (Rupees ten thousand) each with two sureties each for the like sum to the satisfaction of the arresting police officials and also on a condition that the petitioners/A5 and A14 shall make themselves available for investigation as and when required and that they 1 2010 AIR SCW 405 3 shall not cause any threat, inducement or promise to the prosecution witnesses. 7. 7. Further, the petitioners/A5 and A14 shall appear before the Station House Officer, Nallapadu Police Station, Guntur District, once in a week i.e. on every Sunday between 10.00 a.m., and 5.00 p.m., till filing of charge sheet. 8. Accordingly, the Criminal Petition is allowed. 9. As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed. _______________________ K.
