.....Petitioners
Through: Mr. Atul Kumar Sharma, Advocate
versus
STATE GOVT. OF NCT OF DELHI AND ANR. .....Respondents Through: Mr. Amit Ahlawat, APP for State with SI S. Khan, PS Wazirabad
CORAM:
HON'BLE MR. JUSTICE GIRISH KATHPALIA
O R D E R %
08.04.2026
1. At the outset, it is pointed out by learned APP for State that the impugned FIR was registered consequent upon an order under Section 156(3) CrPC but the order under Section 156(3) CrPC has not been challenged by the petitioners.
2.
Learned counsel for petitioners seeks permission to withdraw this petition with liberty to challenge the order under Section 156(3) CrPC, contending that petitioners were in good faith prosecuting this case in wrong court, instead of filing revision petition against the order under Section 156(3) CrPC.
3. As requested, the petition and accompanying applications are dismissed as withdrawn with liberty as sought.
