(Oral) It is the case of the petitioner that he responded to an advertisement issued on 22.12.2001 by the respondent no. 2/the Director General of Police, Uttarakhand, Dehradun for appointment to the post of Sub Inspector Civil Police/Platoon Commander (PAC). The petitioner was declared unsuccessful. He took legal recourse. Finally his Writ Petition (S/S) No. 2014 of 2018, Jitendra Joshi v. State of Uttarakhand & others (“the First Petition”) was allowed by this Court on 27.05.2020, against which Special Appeal No. 149 of 2022, State of Uttarakhand & others v. Jitendra Joshi, was also dismissed on 29.08.2020. This order dated 29.08.2020 in Special Appeal was challenged by the State of Uttarakhand in Civil Appeal No. 3128 of 2022, the State of Uttarakhand v. Jitendra Joshi, before the Hon’ble Supreme Court, but it was also dismissed on 17.11.2022. The petitioner has been given appointment, but his seniority has not been fixed. Now, the petitioner claims that the respondent authorities may be directed to fix his seniority. 2. Heard learned counsel for the parties and perused the record. 2 3. Learned counsel for the petitioner would submit that after a long legal battle, the petitioner was given appointment on 12.012023, by the order of the Hon’ble Apex Court; but, his seniority has yet not been fixed. 4. Learned State Counsel would submit that the Police Headquarters has already recommended the matter to the respondent no. 1 seeking guidance with regard to seniority of the petitioner. 5. This Court need not be detained in the matter any longer. This Court directs the respondent no. 1/the Principal Secretary, Home, State of Uttarakhand to decide the seniority of the petitioner within a period of four weeks from today. 6. With the direction as above, the writ petition stands disposed of accordingly. 7.
