Neutral Citation No. - 2025:AHC:18632 Court No. - 73 Case :- APPLICATION U/S 482 No. - 39149 of 2024 Applicant :- Dilip Kumar Opposite Party :- State of U.P. and Another Counsel for Applicant :- Brahm Prakash Mishra Counsel for Opposite Party :- G.A. Hon'ble Raj Beer Singh,J. 1. Heard learned counsel for the applicant and learned A.G.A. for the State. 2. This application u/s 482 Cr.P.C. has been preferred against the order dated 05.08.2023, passed by the Principal Judge, Family Court, Bhadohi Gyanpur in case no. F 467 of 2023, under Section 128 Cr.P.C., P.S. Aurai, District Bhadohi. 3. Perusal of record shows that by impugned order dated 05.08.2023 the Family court has merely registered the case under section 128 CrPC and notice has been issued to the opposite party (applicant herein) and next date was fixed for objections/hearing. Apparently in the impugned order there is no illegality or perversity. In case the applicant has any grievance regarding quantum of arrears of maintenance, he can file his objections before the Family court concerned. 4. After considering entire facts, this Court does not find any such patent illegality or abuse of the process of court in the impugned order so as to require any interference by this Court by invoking inherent powers under Section 482 Cr.P.C. The application u/s 482 Cr.P.C. lacks merit and thus, liable to be dismissed. 5. The application under Section 482 Cr.P.C. is hereby dismissed.
