Issue a writ, order or direction in the nature of Mandamus directing the respondent no. 2 i.e Sub Divisional Magistrate, Padrauna district Kushinagar to decide the restoration case no. T20050544010007 (Yaduvendra Pratap Narayan Singh Vs. Dev Kumar and others) against the order dated 30.04.2001 in case no.127/2000 under section 33/49 of Land Revenue Act (Krishna Sevak Mal Vs. Yaduvendra) in respect of kasba Padrauna Tappa Pakdi gangrani Pargna Sidhuwa Jobna Tahsil Padrauna district Kushinagar, which is pending before him, within stipulated period which is fixed by this Hon'ble Court." 3. From perusal of the writ petition and annexures annexed thereto, it appears that the aforementioned restoration application is pending before respondent no.2 for adjudication. 4. No useful purpose would be served in keeping this petition pending. 5. The present petition stands disposed of finally with a direction to the respondent No. 2, Sub Divisional Magistrate, Padrauna, District- Kushinagar to consider and decide the aforementioned restoration application in accordance with law, expeditiously, preferably within a period of two months from the date of production of a certified copy of this order after ensuring service upon all the respondents and after giving opportunity of hearing to the parties concerned provided that there is no other legal impediment.
