Heard learned Standing Counsel for the State-respondents and perused the record. 2. The instant writ petition has been filed for following relief: "I. Issue a writ, order or direction in the nature of Mandamus commanding and directing the respondent no. 2 i.e Sub Divisional Magistrate, Tehsil- Phoolpur, District- Allahabad/Prayagraj to decide the Old Case No. 387 of 2007 Smt. Vimla Devi Versus Sita Ram and others) and Present Misc. Restoration Application No. 268 of 2018, (Smt. Vimla Devi Versus Gaon Sabha and others), under Section 24 of U.P. Revenue Code, Mauja-Paharpur, Pargana-Jhunsi, Tehsil- Phoolpur, District-Allahabad/Prayagraj as early as possible within stipulated period as fixed by this Hon'ble Court." 3. From perusal of the writ petition and annexures annexed thereto, it appears that the aforementioned restoration application is pending before respondent no.2 for adjudication. 4. No useful purpose would be served in keeping this petition pending. 5. The present petition stands disposed of finally with a direction to the respondent No. 2, Sub Divisional Magistrate, Tehsil- Phoolpur, District- Prayagraj to consider and decide the aforementioned restoration application in accordance with law, expeditiously, preferably within a period of three months from the date of production of a certified copy of this order after ensuring service upon all the respondents and after giving opportunity of hearing to the parties concerned provided that there is no other legal impediment.
