Neutral Citation No. - 2025:AHC:20383-DB Court No. - 29 Case :- WRIT - C No. - 37799 of 2024 Petitioner :- Calector Singh @ Kalaktor Respondent :- State Of Up And 4 Others Counsel for Petitioner :- Aditya Kumar Tripathi Counsel for Respondent :- C.S.C.,Kunal Ravi Singh Hon'ble Ashwani Kumar Mishra,J. Hon'ble Arun Kumar Singh Deshwal,J. Petitioner is aggrieved by denial of information sought under the RTI Act. It transpires that an appeal was also preferred, which had various shortcomings and the petitioner was returned the memo with liberty to remove defects and file afresh.
Learned counsel for the respondent states that thereafter no fresh appeal has been filed. No writ of mandamus is required to be issued in the facts of this case, inasmuch as, statutory remedy under the Act has not been exhausted. We however permit the petitioner to present the second appeal, afresh, annexing all materials, after removing the defects, together with a copy of this order within two weeks from today, which shall be entertained on its own merits without raising any objection with regard to the limitation and shall be dealt with, expeditiously, in accordance with law.
Disposed off, accordingly.
