Mr. H.S. Paonam, learned senior counsel for the petitioners, submits that vide order dated 09-02-2024 passed by this Court in WP(C) No. 106 of NINGOM BAM VICTORIA Digitally signed by NINGOMBAM VICTORIA Date: 2025.06.12 17:02:24 +05'30' 2024, it was observed in para 11 that the impugned final seniority list dated 25-07-2023 of Assistant Engineers in RED, Government of Manipur shall not be acted upon if not already acted. At the Bar, it is submitted that the Department is contemplating promotion from the post of Assistant Engineer to the post of Executive Engineer. However, due to interim order dated 09-02-2024 of keeping final seniority list in abeyance, the proceedings of promotion cannot be initiated. It is submitted that interim order may be modified to the extent that the Department may act upon the impugned final seniority list dated 25-07-2023 for the purpose of promotion to the post of Executive Engineer. It is also stated that there are more posts than the number of eligible persons to be promoted. In the circumstance, the interim order dated 09-02-2024 is modified that the Department may act upon the impugned final seniority list dated 25-07-2023 for the purpose of promotion to the post of Executive Engineer. However, any promotion made thereto shall be subject to the outcome of the writ petition. With this observation, MC(WP(C)) No. 292 of 2024 and MC(WP(C)) No. 293 of 2024 are closed. List the remaining matters on 18-07-2025. Interim order passed in WP(C) No. 137 of 2024 and the subsequent extension orders passed in both the writ petitions are modified in terms of the above direction. JUDGE Victoria
